Unless specified otherwise, Grabba warrants to the Purchaser that Grabba branded products, (excluding third party products) will be free from defects in materials and workmanship affecting normal use for a period of one year from the date of the Invoice evidencing original supply of Grabba Hardware to a Grabba commercial Customer.

HARDWARE WARRANTY

Insofar as is permitted by law, the warranty provided in this Warranty Statement applies only to such specified Hardware items (not software) purchased for use by the original purchaser and is not transferable to any subsequent user. The term “Hardware” means a unique, serial numbered Grabba device, its features, upgrades, elements or any combination of them at time of purchase.

Warranty

It is warranted that each item of Hardware is free from defects in materials and workmanship and conforms to published specifications. Purchaser acknowledges that it is not relying on the seller’s skill or judgment to select or furnish goods suitable for any particular purpose. Commencement of the warranty period is from the date of invoice for original supply.

Only Grabba or a Grabba authorised repairer is authorised to service or repair the Hardware. This warranty is void if the Hardware:

a) Has been tampered with, upgraded or has been serviced by any unauthorised persons,

b) If any tamper evident seals are broken or removed.

During the warranty period, Grabba or an authorised repairer will provide warranty service for the item of Hardware and, where appropriate, will manage and install engineering changes that apply to the item of Hardware.

When a service involves the exchange of a Hardware part, the part replaced becomes the property of Grabba and the replacement Hardware part becomes the property of the customer. Any Hardware part provided as a replacement will be in good working order and will assume whatever remaining warranty period that was required of the part replaced. Repairs may be conducted with new and/or serviceable used parts (which perform like new parts).

Warranty Repair

To obtain warranty Repair you may be required to present proof of purchase.

It is your responsibility:

a) To obtain a Return to Manufacturer Authorisation (RMA) from Grabba

b) To ensure that a Hardware is appropriately packaged and shipped to the location advised at the time of issue of the RMA.

c) If applicable, before an RMA is provided, to carry out any requested test procedures that Grabba Support provides. You must only return items for repair as instructed by the Grabba support.

Extent of Warranty

This warranty does not cover uninterrupted or error-free operation of an item of Hardware, misuse, accident, repair of cosmetic marks, improper maintenance by the user, or failure caused by a third party product, which is not part of the original Hardware. This warranty does not cover any data loss or consequential loss resulting from the malfunction of the Hardware.

This warranty is in addition to any rights you may have under any Consumer Protection Act or other legislation, which cannot be excluded or limited and replaces all other conditions and warranties that may otherwise be implied.

Exclusions from Cover

Insofar as is permitted by law, this warranty will not cover any loss or damage:

a) Arising from or out of misuse of the Hardware, fire, lightning, explosion, malicious damage, storm and/or tempest, water damage or accidental damage.

b) Directly or indirectly caused as a result of war, riots, civil unrest or Act of God.

c) Arising from or relating to the attachment of or incorporation into the Hardware of additional products or components, unless such attachment or incorporation is an attachment or incorporation made as a function of the normal expected use of the Hardware.

d) Arising from or relating to any batteries, cables, connectors or Grabba supplied chargers unless advised within three (3) months of original purchase date.

e) Relating to or arising from any damage resulting from voltage spikes or other fluctuations in supply to a Grabba supplied charger.

f) In respect of loss of benefits or profits, work stoppage, or loss or impairment of data howsoever arising out of the use or inability to use the Hardware, or in connection with guarantee of performance or efficiency.

g) Relating to third party property damage and/or third party bodily injury.

h) Any loss or damage directly or indirectly caused as a result of viral contamination.

i) Arising out of any failure, malfunction, defect, inoperability, breakdown, disruption or stoppage of the Hardware or any Hardware functions or the function of any related components caused by, arising from or related to, directly or indirectly any design, planning or engineering compatibility, omission or deficiency of third party products or systems to which the Hardware is connected.
